Pembahasan revisi Undang-Undang Minyak dan Gas Bumi (RUU Migas) di DPR RI belakangan dikebut. Namun, di tengah percepatan tersebut, pembahasan beleid yang akan menggantikan UU Nomor 22 Tahun 2001 itu masih berlangsung alot.<\/p>\n\n\n\n
Adapun, salah satu isu utama yang menjadi perhatian yakni rencana pembentukan Badan Usaha Khusus (BUK) Migas). Keberadaan lembaga baru itu akan menggantikan peran Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) yang diproyeksikan membawa perubahan besar terhadap tata kelola industri migas nasional.<\/p>\n\n\n\n
Lalu apakah BUK Migas ini mampu mengangkat kembali derajat Indonesia menjadi 'Raja' minyak?<\/p>\n\n\n\n
Persoalan yang mengemuka saat ini bukan hanya mengenai kewenangan BUK Migas, namun juga siapa yang nantinya menjadi operator sekaligus memiliki kendali terhadap lembaga tersebut.<\/p>\n\n\n\n
Dalam pembahasan dan informasi yang diterima CNBC Indonesia, muncul sejumlah opsi mengenai posisi BUK Migas: Pertama, adalah menempatkan BUK Migas langsung di bawah Presiden sehingga memiliki garis pertanggungjawaban langsung kepada kepala negara.<\/p>\n\n\n\n
Kedua, mengaitkan BUK Migas di bawah PT Pertamina (Persero). Ketiga, menempatkan BUK Migas di bawah Kementerian Energi dan Sumber Daya Mineral (ESDM).<\/p>\n\n\n\n
Perbedaan posisi tersebut kemudian menjadi salah satu titik krusial dalam pembahasan RUU Migas.<\/p>\n\n\n\n
Direktur Eksekutif ReforMiner Institute Komaidi Notonegoro menilai berdasarkan draf RUU Migas yang beredar, BUK Migas dirancang sebagai badan usaha khusus atau badan usaha milik negara (BUMN) khusus yang memiliki tugas utama mengelola kegiatan usaha hulu migas.<\/p>\n\n\n\n
\"Kalau di dalam draf yang ada, BUK Migas itu adalah badan usaha khusus atau BUMN khusus yang mengelola di sektor hulu,\" kata Komaidi kepada CNBC Indonesia, dikutip Kamis (10\/9\/2026).<\/p>\n\n\n\n
Menurut Komaidi, konsep BUK Migas memiliki kemiripan dengan kelembagaan yang pernah ada dalam pengelolaan sektor hulu migas. Sebelum terbentuknya BP Migas dan kemudian SKK Migas, fungsi tersebut pernah berada dalam struktur Pertamina.<\/p>\n\n\n\n
\"Jadi mungkin kedudukannya tuh kalau dulu ada BBPKA di dalam unitnya atau direktoratnya Pertamina, yang kemudian berreinkarnasi menjadi BP Migas di dalam Undang-Undang 2\/2001 setelah dibatalkan MK kemudian menjadi SKK Migas. Jadi tugasnya itu khusus untuk mengurusi hulu atau di eksplorasi dan produksi begitu,\" katanya.<\/p>\n\n\n\n
Selain itu, konsep BUK Migas juga memiliki sedikit kemiripan dengan Danantara, terutama dalam hal fungsi pengelolaan. Namun, cakupan BUK Migas akan jauh lebih spesifik karena difokuskan pada sektor hulu migas.<\/p>\n\n\n\n
\"Apakah mirip-mirip Danantara? Danantara lebih di atasnya ya sebetulnya, dalam artian sebagai dirijen secara keseluruhan. Mungkin agak ada miripnya dengan Danantara Investasi tapi di khusus hulu migas, tapi ini akan bekerja sama dengan kontraktor mitra dan bisa melakukan sendiri,\" tambahnya.<\/p>\n\n\n\n
Sementara itu, praktisi minyak dan gas bumi (migas) Hadi Ismoyo menilai BUK Migas yang baru seharusnya memiliki kewenangan yang lebih kuat dibandingkan lembaga pengelola hulu migas sebelumnya.<\/p>\n\n\n\n
Namun demikian, Hadi menilai BUK Migas sebaiknya difokuskan sebagai regulator, sementara fungsi operator tetap dijalankan oleh PT Pertamina (Persero).<\/p>\n\n\n\n
Menurut dia, pembagian fungsi tersebut penting untuk menghindari tumpang tindih kewenangan antara BUK Migas dan Pertamina. Dengan posisi sebagai regulator, BUK Migas dapat menjalankan fungsi pengaturan dan pengelolaan sektor migas secara lebih kuat tanpa mengambil alih peran operasional yang selama ini telah dijalankan Pertamina.<\/p>\n\n\n\n
\"Menurut saya sebaiknya BUK Fokus ke Regulator. Sedangkan Operator kan sudah ada Pertamina. Namun BUK bisa mengalokasikan Petroleum Fund untuk akuisisi data awal sehingga kualitas WKP yang ditawarkan semakin baik dan akurat datanya. Sehingga menarik investor luar negeri big player,\" kata dia.<\/p>\n\n\n\n
Di tengah kondisi Indonesia yang menghadapi tantangan ketahanan energi, ia memandang BUK Migas sebaiknya ditempatkan langsung di bawah Presiden. Pasalnya, posisi tersebut akan membuat lembaga tersebut memiliki kewenangan yang lebih kuat untuk mengeksekusi visi Presiden terkait ketahanan energi nasional.<\/p>\n\n\n\n
Hadi menilai BUK Migas tidak perlu dibentuk dengan konsep menyerupai Danantara. Sebab, konsep tersebut berpotensi menimbulkan tumpang tindih dengan Pertamina, khususnya dalam menjalankan fungsi operasional.<\/p>\n\n\n\n
Selain itu, BUK Migas juga sebaiknya tidak ditempatkan di bawah Pertamina karena dapat mengurangi kewenangan lembaga tersebut. Ia juga tidak merekomendasikan BUK Migas berada di bawah Kementerian ESDM karena dikhawatirkan akan membatasi kemampuan lembaga tersebut dalam mengeksekusi visi Presiden terkait ketahanan energi nasional.<\/p>\n\n\n\n

However, amidst this push for speed, discussions regarding the regulation\u2014which is set to replace Law Number 22 of 2001\u2014remain arduous. One of the key issues drawing attention is the plan to establish a Special Oil and Gas Business Entity (BUK Migas). This new institution would replace the role of the Special Task Force for Upstream Oil and Gas Business Activities (SKK Migas), a move projected to bring about major changes to the governance of the national oil and gas industry. So, will this BUK Migas be capable of elevating Indonesia\u2019s status once again to that of an oil “King”? The issues currently coming to the fore concern not only the authority of the BUK Migas but also who will act as the operator and hold control over the institution. Based on discussions and information received by CNBC Indonesia, several options regarding the positioning of the BUK Migas have emerged: First, placing the BUK Migas directly under the President, thereby establishing a direct line of accountability to the head of state. Second, placing the BUK Migas under PT Pertamina (Persero). Third, placing the BUK Migas under the Ministry of Energy and Mineral Resources (ESDM). These differing views on its positioning have become a crucial point in the deliberations on the Oil and Gas Bill. Komaidi Notonegoro, Executive Director of the ReforMiner Institute, assesses that\u2014based on the circulating draft of the bill\u2014the BUK Migas is designed as a special business entity or a special state-owned enterprise (BUMN) tasked primarily with managing upstream oil and gas business activities. “In the existing draft, the BUK Migas is a special business entity or special state-owned enterprise that manages the upstream sector,” Komaidi told CNBC Indonesia, as cited on Thursday (September 10, 2026). According to Komaidi, the concept of the BUK Migas bears similarities to institutional models that previously existed for managing the upstream oil and gas sector. Prior to the establishment of BP Migas and subsequently SKK Migas, this function was housed within Pertamina’s organizational structure. “In the past, the role was held by the BBPKA\u2014part of a Pertamina unit or directorate\u2014which later reincarnated as BP Migas under Law No. 2\/2001, and subsequently became SKK Migas after the Constitutional Court annulled the previous arrangement. Its mandate is specifically to manage the upstream sector\u2014namely exploration and production,” he said. Furthermore, the BUK Migas concept bears some resemblance to Danantara, particularly regarding management functions. However, the scope of BUK Migas would be far more specific, as it focuses on the upstream oil and gas sector. “Is it similar to Danantara? Danantara actually sits at a higher level, acting as an overarching orchestrator. There might be some resemblance to Danantara Investasi\u2014specifically regarding the upstream oil and gas sector\u2014but this entity would collaborate with partner contractors while also retaining the capacity to operate independently,” he added. Meanwhile, oil and gas practitioner Hadi Ismoyo believes that the new BUK Migas entity should possess stronger authority than previous upstream oil and gas management bodies. However, Hadi suggests that BUK Migas should focus on its role as a regulator, while operational functions remain the responsibility of PT Pertamina (Persero). According to him, this division of functions is crucial to avoid overlapping authority between BUK Migas and Pertamina. By acting as a regulator, BUK Migas could more effectively manage and regulate the sector without usurping the operational roles that Pertamina has long performed. “In my view, BUK should focus on regulation, whereas Pertamina already handles operations. However, BUK could allocate the Petroleum Fund for initial data acquisition; this would improve the quality and accuracy of the data for the offered Working Areas (WKP), thereby attracting major foreign investors,” he said. Given the energy security challenges Indonesia faces, he believes BUK Migas should be placed directly under the President. Such a position would grant the agency greater authority to execute the President’s vision for national energy security. Hadi argues that BUK Migas need not be modeled after Danantara, as that concept could lead to overlaps with Pertamina, particularly regarding operational functions. Furthermore, BUK Migas should not be placed under Pertamina, as this could diminish the agency’s authority. He also advises against placing it under the Ministry of Energy and Mineral Resources (ESDM), fearing that doing so might constrain the agency’s ability to execute the President’s vision for national energy security. “BUK should be placed under the President to ensure greater authority. It should not be placed under Pertamina; doing so would diminish its powers. The organizational structure should feature a direct reporting line to the President and a dotted line for coordination with the Ministry of Energy and Mineral Resources (KESDM). BUK should not be placed under the Ministry of Energy and Mineral Resources either.
