{"id":6589,"date":"2024-06-04T11:06:00","date_gmt":"2024-06-04T04:06:00","guid":{"rendered":"https:\/\/bakrie-brothers.com\/?p=6589"},"modified":"2024-06-04T11:10:01","modified_gmt":"2024-06-04T04:10:01","slug":"the-urgency-of-preparing-the-legal-basis-for-the-ebt-transition-in-indonesia","status":"publish","type":"post","link":"https:\/\/bakrie-brothers.com\/id\/announcements\/the-urgency-of-preparing-the-legal-basis-for-the-ebt-transition-in-indonesia\/","title":{"rendered":"Urgensi Menyiapkan Pijakan Yuridis Transisi EBT di Indonesia"},"content":{"rendered":"<p>Sumber : Antaranews.com | 3 Juni 2024<\/p>\n\n\n\n<p>Masyarakat Indonesia selama puluhan dekade dihadapkan pada ketergantungan energi fosil dan terbatasnya jaminan masa depan akan perubahan sumber energi fosil menuju sumber energi yang dapat diperbaharui.<\/p>\n\n\n\n<p>Tanpa ada payung hukum komprehensif yang menjamin proses menuju transisi energi baru terbarukan (EBT), hal itu malah memudahkan aktivitas tambang energi tak terbarukan sekaligus menghambat laju progres transisi energi terbarukan.<\/p>\n\n\n\n<p>Studi dari Rialp-Criado dkk. pada tahun 2020 dengan jelas memberikan gambaran pada 12 negara yang terbukti optimal membangun industri energi terbarukan melalui intervensi negara melalui kombinasi dukungan langsung maupun tidak langsung.<\/p>\n\n\n\n<p>Berbagai contoh keberhasilan beberapa negara tersebut menjadi menarik jika disandingkan dengan Indonesia yang memiliki potensi energi terbarukan sangat besar, namun hingga kini bauran energi terbarukan hanya mencapai 13,1 persen pada tahun 2023, dengan target 23 persen pada tahun 2025.<\/p>\n\n\n\n<p>Indonesia menyimpan potensi energi terbarukan mencapai 441,7 GW, ditambah lagi kondisi geografi serta geologi Indonesia yang benar-benar menjanjikan jika dimanfaatkan untuk pengembangan energi terbarukan, misalnya, tenaga surya, angin, air, hingga bioenergi. Pun pada potensi pasar energi terbarukan Indonesia khususnya di sektor komersial dan industri.<\/p>\n\n\n\n<p>Sebagai contoh, potensi energi surya yang dapat dimaksimalkan mencapai 207,8 gigawatt namun baru digunakan di Indonesia saat ini adalah kurang dari 1 persen (IESR, 2021).<\/p>\n\n\n\n<p>Belum lagi potensi energi air yang dimiliki sejumlah 94,4 MW, kemudian energi angin dengan potensi 978 MW, hingga potensi energi panas Bumi sebesar 28,91 GW.<\/p>\n\n\n\n<p>Potensi energi terbarukan Indonesia sebesar itu seharusnya dapat menyokong kemandirian dan ketahanan energi dalam negeri. Namun, pengoptimalannya sejauh ini masih jauh di bawah angka ideal yang berkisar hanya 13 persen saja.<\/p>\n\n\n\n<p>Hambatan Yuridis<\/p>\n\n\n\n<p>Instrumen yuridis menjadi salah satu faktor utama yang dapat menentukan sebuah negara untuk dapat mengoptimalkan potensi energi terbarukan.<\/p>\n\n\n\n<p>Dalam hal ini, Jerman dapat dijadikan role model suksesnya instrumen yuridis dalam mengembangkan potensi energi terbarukan dengan berbagai rancangan kebijakan publik serta instrumen yuridis yang bersifat advanced dan terintegrasi, antara lain, StrEG dan Erneuerbare-Energien-Gesetz (EEG) yang merupakan peraturan dengan skema feed-in tariff atau UU yang memudahkan pelaksanaan investasi di sektor energi terbarukan.<\/p>\n\n\n\n<p>Upaya yuridis tersebut bukannya tanpa pernah dilakukan Pemerintah Indonesia. Jauh sebelumnya sudah terdapat kerangka dan konstruksi penggunaan energi terbarukan, yang salah satunya tertuang pada Pasal 33 ayat (3) UUD 1945 yang berbunyi: \u201cBumi, air, dan kekayaan alam yang terkandung di dalamnya, dikuasai negara dan dipergunakan sebesar-besarnya untuk kemakmuran rakyat\u201d.<\/p>\n\n\n\n<p>Pasal tersebut pun menjadi landasan lahirnya beberapa peraturan perundang-undangan yang mengatur soal energi terbarukan, seperti pada UU No. 30 Tahun 2007 yang mengatur persoalan energi, kemudian UU No. 30 Tahun 2009 yang mengatur ketenagalistrikan, hingga UU No. 21 Tahun 2014 yang mengatur perihal panas Bumi.<\/p>\n\n\n\n<p>Namun, peraturan perundang-undangan yang membahas tentang transisi energi tersebut masih tersebar di berbagai undang-undang. Pada sisi lain, belum dapat undang-undang yang spesifik dan sistemik untuk mengatur persoalan energi terbarukan.<\/p>\n\n\n\n<p>Permasalahan besar tersebut sempat terjawab ketika pemerintah bersama DPR merumuskan Rancangan Undang-Undang Energi Baru dan Terbarukan (RUU EBT). RUU EBT telah masuk dalam Prolegnas 2022 dengan tujuan yang jelas sebagai aktualisasi hak penguasaan negara atas energi terbarukan demi kesejahteraan rakyat berlandaskan Pasal 20, Pasal 21, dan Pasal 33 UUD 1945.<\/p>\n\n\n\n<p>Jika ditinjau lebih dalam, terdapat beberapa kelemahan RUU EBT yang sedang disusun. Pertama, belum diperhatikannya konsep trilema energi yang diperkenalkan oleh World Energy Council pada tahun 2010. Sederhananya, konsep ini memaparkan tiga aspek keseimbangan yang dibutuhkan dalam pemenuhan dan pemerataan energi, antara lain: (1) Energy Security, (2) Energy Access, (3) Environmental Sustainability.<\/p>\n\n\n\n<p>Di antara ketiga aspek tersebut, RUU EBT masih berkonsentrasi pada energy security semata dan seakan mengesampingkan dua aspek lainnya. Contoh pada Bab IV tentang Penyediaan dan Pemanfaatan yang mencakup Pasal 20 sampai Pasal 26 yang memperlihatkan RUU ini mendorong penyediaan energi terbarukan dengan memaksimalkan peran dari badan usaha.<\/p>\n\n\n\n<p>Namun, dalam pasal lain tidak dijelaskan secara detail perihal akses masyarakat terhadap energi terkait dari segi fisik. Tidak pula dijelaskan mengenai tarif yang dapat akan dibebankan pada konsumsi masyarakat ke depannya.<\/p>\n\n\n\n<p>Kedua, masalah ambiguitas pada prioritas energi. Fatalnya, masih terlihat upaya Pemerintah dalam penggunaan energi fosil yang tertuang dalam RUU EBT. Dari total 40 pasal yang ada, seluruh terminologi yang digunakan untuk mengelola sumber energi terbarukan tak terpisahkan dari pengelolaan energi baru.<\/p>\n\n\n\n<p>Energi baru tersebut berasal dari pengolahan energi fosil layaknya energi nuklir serta gas metana batu bara (coal bed methane). Lantas, dalam RUU EBT ini mana yang sebenarnya diprioritaskan Pemerintah. Apakah energi terbarukan, atau energi baru yang tetap menggunakan pengolahan energi fosil?<\/p>\n\n\n\n<p>Jelas terlihat bahwa instrumen hukum kita masih belum secara detail mengatur skema perpindahan menuju energi terbarukan sebagai pemasok kebutuhan energi dalam negeri. Aspek yuridis yang menjadi prioritas utama untuk dapat menyukseskan peralihan energi terbarukan masih ada dalam wacana parlemen tanpa jaminan hasil yang diharapkan.<\/p>\n\n\n\n<p>Oleh karena itu, harapan besar masyarakat Indonesia terhadap RUU EBT harus dijawab Pemerintah dengan baik agar dapat memberikan kontribusi besar terhadap upaya transisi energi maupun dekarbonisasi serta mewujudkan kedaulatan lingkungan yang menjadi cita-cita bersama.<\/p>\n\n\n\n<p>Peralihan menuju energi terbarukan merupakan keniscayaan sehingga segenap kebijakan dan regulasi yang mendukungnya harus diterbitkan, termasuk dalam menyiapkan pijakan yuridis EBT yang komprehensif.<\/p>\n\n\n\n<p>*) M. Without a comprehensive legal umbrella that guarantees the process towards a new renewable energy (EBT) transition, this will actually facilitate non-renewable energy mining activities while also hampering the progress of the renewable energy transition. The study of Rialp-Criado et al. in 2020 clearly provides a picture of 12 countries that have proven optimal in developing renewable energy industries through state intervention through a combination of direct and indirect support. Various examples of the success of several countries become interesting when compared with Indonesia, which has enormous renewable energy potential, but up to now the renewable energy mix has only reached 13.1 percent in 2023, with a target of 23 percent in 2025. Indonesia has renewable energy potential reaching 441.7 GW, plus Indonesia&#8217;s geographical and geological conditions are truly promising if utilized for the development of renewable energy, for example, solar, wind, water and bioenergy. Also regarding the potential of the Indonesian renewable energy market, especially in the commercial and industrial sectors. For example, the potential for solar energy that can be maximized reaches 207.8 gigawatts but is currently only used in Indonesia at less than 1 percent (IESR, 2021). Not to mention the potential for water energy which is 94.4 MW, then wind energy with a potential of 978 MW, and geothermal energy potential of 28.91 GW. Indonesia&#8217;s renewable energy potential should be able to support domestic energy independence and security. However, the optimization so far is still far below the ideal figure, which is only around 13 percent. Juridical obstacles Juridical instruments are one of the main factors that can determine whether a country can optimize its renewable energy potential. In this case, Germany can be used as a role model for the success of legal instruments in developing renewable energy potential with various public policy designs and advanced and integrated legal instruments, including, StrEG and Erneuerbare-Energien-Gesetz (EEG) which are regulations with a feed scheme. -in tariffs or laws that facilitate the implementation of investment in the renewable energy sector. This juridical effort has not been carried out without the Indonesian Government. Long before that there was already a framework and construction for the use of renewable energy, one of which is stated in Article 33 paragraph (3) of the 1945 Constitution which reads: &#8220;Earth, water and the natural resources contained therein, are controlled by the state and used as much as possible for the prosperity of the people \u201d. This article also became the basis for the birth of several laws and regulations governing renewable energy, such as Law no. 30 of 2007 which regulates energy issues, then Law no. 30 of 2009 which regulates electricity, to Law no. 21 of 2014 which regulates geothermal heat. However, the legal regulations discussing the energy transition are still scattered across various laws. On the other hand, there is no specific and systemic law to regulate renewable energy issues. This big problem was answered when the government together with the DPR formulated the New and Renewable Energy Bill (RUU EBT). The EBT Bill has been included in the 2022 Prolegnas with the clear aim of actualizing the state&#8217;s right to control renewable energy for the welfare of the people based on Article 20, Article 21 and Article 33 of the 1945 Constitution. If we look more deeply, there are several weaknesses in the EBT Bill that is being drafted. Firstly, the concept of the energy trilemma which was introduced by the World Energy Council in 2010 has not been paid attention to. Simply put, this concept describes three aspects of balance needed to fulfill and distribute energy, including: (1) Energy Security, (2) Energy Access, (3) ) Environmental Sustainability. Among these three aspects, the EBT Bill still concentrates on energy security alone and seems to ignore the other two aspects. An example in Chapter IV concerning Provision and Utilization which includes Articles 20 to Article 26 shows that this bill encourages the provision of renewable energy by maximizing the role of business entities. However, other articles do not explain in detail the public&#8217;s access to related energy from a physical perspective. It also does not explain the tariffs that will be charged to public consumption in the future. Second, the problem of ambiguity in energy priorities. Fatally, the Government&#8217;s efforts to use fossil energy as outlined in the EBT Bill are still visible. Of the total of 40 existing articles, all the terminology used to manage renewable energy sources is inseparable from new energy management. This new energy comes from processing fossil energy such as nuclear energy and coal bed methane gas. So, in this EBT Bill, what is the Government actually prioritizing? Is it renewable energy, or new energy that still uses fossil energy processing? It is clear that our legal instruments still do not regulate in detail the scheme for moving towards renewable energy as a supplier of domestic energy needs. The juridical aspect which is the main priority to make the transition to renewable energy a success is still present in parliamentary discourse without any guarantee of the expected results. Therefore, the government must answer the high hopes of the Indonesian people regarding the EBT Bill properly so that it can make a major contribution to energy transition and decarbonization efforts as well as realizing environmental sovereignty which is a common goal. The transition to renewable energy is an inevitability so all policies and regulations that support it must be issued, including preparing a comprehensive legal framework for EBT. *) M.
